Terms of Service

These Terms of Service govern the services provided by Growmetry, LLC (“Growmetry,” “we,” “us,” or “our”) to its clients. By engaging Growmetry for services, you agree to these terms.

1. Services

Growmetry provides automation infrastructure services including CRM & lead automation systems and reporting & analytics infrastructure. The specific scope of services for each client is defined in a written Statement of Work (SOW) or service agreement agreed upon by both parties prior to the commencement of work.

2. Payment Terms

Services are scoped and priced per engagement. Specific pricing, payment schedules, and billing terms are outlined in the applicable Statement of Work. Unless otherwise specified in the SOW, invoices are due within 14 days of the invoice date. For retainer engagements, fees are billed monthly in advance.

3. Refund and Cancellation Policy

Deposits: All deposits paid to begin a project are non-refundable. Deposits secure Growmetry's capacity and time for your engagement.

Project cancellation: If a client cancels a project after work has commenced, the client is responsible for payment of all work completed to date at the agreed project rate. Any unused portion of a prepaid project fee beyond work completed may be applied as a credit toward future engagements, at Growmetry's discretion.

Retainer cancellation: Retainer agreements may be cancelled with 30 days written notice. Unused retainer hours from the current billing period are non-refundable but may be applied to future work if a new engagement begins within 90 days.

4. Intellectual Property

Upon receipt of full payment, the client owns all custom automation systems and deliverables created specifically for them under the applicable SOW. Growmetry retains ownership of any general frameworks, tools, or methodologies developed independently.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Growmetry's total liability to any client for any claim arising out of or relating to services shall not exceed the total amount paid by that client to Growmetry in the three months preceding the claim. In no event shall Growmetry be liable for indirect, incidental, special, or consequential damages.

6. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.

7. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. The date at the top of this page reflects the most recent revision.
